This Privacy Policy applies to Tension LLC (referred to as “Tension”, the “Company”, “we”, or “us”) with respect to users in the United States (“U.S.”) and describes what information we collect about you, how we use it, who we share it with, how we protect it, and any rights you may have regarding its use. This Privacy Policy applies to personal information collected through:

  • your use of our services;

  • Visiting www.tensionstrength.com and any other websites, mobile apps, or other online services that display or link to this Privacy Policy (collectively, “online environments”); and

  • Information shared with us by other sources.

Information We Collect

Personal information is generally considered any information that can identify you or that relates specifically to you. The personal information we collect about you depends on how you interact with us and our services, what requests you make from us, and the context of our relationship.

Information You Give Us

While using our services, you may provide certain personally identifiable information that can be used to contact or identify you. This may include, but is not limited to:

  • Identification and Contact Data. Data that specifically identifies you or allows us to contact you, such as your first name, middle name or initial, last name, nickname or alias, postal address, e-mail address, social media network details, or phone number.

  • Account Login Data. Data that is required to give you access to your specific account profile. Examples include your login ID/email address, screen name, password, and/or security question and answer.

  • Payment and Financial Data. Data that you use to make a purchase, such as your bank account number, credit or debit card number, or other financial information, which we pass on to our third-party payment provider as described under the “How We Use Information We Collect” section below. 

  • Demographic Data. Data that describes or identifies demographic characteristics, such as age or age range, gender identification, geographic location (e.g., ZIP code), hobbies and interests, or lifestyle data.

  • Other information you choose to provide, such as through emails or other communications, social media pages, surveys, registrations, and sign-up forms.

Technical Information Collected Automatically

When you visit our websites, we may obtain certain information by automated means, such as through cookies, web beacons, web server logs and other technologies. A “cookie” is a text file that websites send to a visitor’s computer or other internet-connected device to uniquely identify the visitor’s browser or to store information or settings in the browser. A “web beacon,” also known as an internet tag, pixel tag or clear GIF, links web pages to web servers and cookies and may be used to transmit information collected through cookies back to a web server. The information we collect in this manner may include your device IP address, unique device identifier, web browser characteristics, device characteristics, operating system, language preferences, referring URLs, clickstream data, and dates and times of your website visits.

When you use our mobile apps, we also may collect certain information by automated means, such as through device logs, server logs and other technologies. The information we collect in this manner may include the device type used, the device’s mobile operating system, device identifiers and similar unique identifiers, device settings and configurations, IP addresses, battery and signal strength, usage statistics, referring emails and web addresses, dates and times of usage, actions taken on mobile apps, and other information regarding your use of the mobile apps.

This information can make your use of our online environments easier and more meaningful by allowing us to provide better service, customize our online environments based on your preferences, compile statistics, provide you with more relevant advertisements, analyze trends, and otherwise administer and improve our online environments. 

We may combine the information we collect through our online environments with information we collect through other online environments, such as third-party websites, and our offline environments, as well as with information provided by our partners. We use this consolidated information to help us improve our online environments, products, and services; to communicate information to you; to enhance our marketing and research activities; and to engage in any other uses described in the “HOW WE USE THE INFORMATION WE COLLECT” section below.

Information Collected from Third Parties

Our advertising vendors may share information with us regarding our ads on websites or apps where such ads run.  This enables us to measure and improve those ads by including information such as whether clicks on ads led to purchases, or a list of criteria to use in targeting ads.  We may obtain information from other business partners, such as co-sponsors with whom we may partner to run co-branded promotions.  We also may obtain information from commercially available sources such as data aggregators, marketing firms, and public databases to provide us with additional information about consumers (this is known as “data appending”).  This information may include name, demographic information, contact information, interests, and publicly available data, such as from social media.  

How We Use Information We Collect

We may use personal information for the following purposes:

  • To provide and maintain our service, including to monitor the usage of our service.

  • To manage your account: to manage your registration as a user of the service. The personal information you provide can give you access to different functionalities of the service that are available to you as a registered user.

  • For the performance of a contract: the development, compliance and undertaking of the purchase contract for the items or services you have purchased or of any other contract with us through the service.

  • To contact you: To contact you by email, telephone calls, SMS, or other equivalent forms of electronic communication, such as a mobile application's push notifications regarding updates or informative communications related to the functionalities or contracted services, including the security updates, when necessary or reasonable for their implementation.

  • To provide you with news, special offers and general information about other services and events which we offer that are similar to those that you have already purchased or inquired about unless you have opted not to receive such information.

  • To manage your requests: To attend and manage your requests to us.

  • For business transfers: We may use your information to evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by us about our service users is among the assets transferred.

  • For other purposes: We may use your information for other purposes, such as data analysis, identifying usage trends, determining the effectiveness of our promotional campaigns and to evaluate and improve our services, marketing, and your experience.

We may share your personal information in the following situations:

  • With Service Providers: We may share your personal information with Service Providers to monitor and analyze the use of our service, or to contact you.

  • For business transfers: We may share or transfer your personal information in connection with, or during negotiations of, any merger, sale of Company assets, financing, or acquisition of all or a portion of our business by another company.

  • With business partners: We may share your personal information with our business partners to offer you certain products, services or promotions.

  • With other users: When you share personal information or otherwise interact in the public areas with other users, such information may be viewed by all users and may be publicly distributed outside our site. If you interact with other users or register through a third-party social media service, your contacts on the third-party social media service may see your name, profile, pictures and description of your activity. Similarly, other users will be able to view descriptions of your activity, communicate with you, and view your profile.

  • With your consent: We may disclose your personal information for any other purpose with your consent.

 

We may also use the information we collect in other ways for which we provide specific notice at the time of collection.

Third-Party Analytics Services

We may use third-party analytics services in our online environments, such as Google Analytics. The providers of these analytics services use technologies such as cookies and web beacons to help us analyze your use of our online environments. The information collected through these means may be disclosed to or collected directly by these services. Interest-Based Advertising

You may see our ads on other websites because we use third-party ad services on our online environments. Through these ad services, we can tailor our messaging to individuals using demographic data, inferred interests and browsing context. These ad services track information about your online activities over time and across third-party websites and apps by collecting information through automated means, including through the use of cookies, web server logs, web beacons and other similar technologies. These ad services may collect data about your visits to websites and apps that participate in these services, such as the pages or ads you view and the actions you take on the websites or apps. This data collection takes place both on our online environments and on third-party websites and apps that participate in these ad services. These ad services use this information to show you ads that may be tailored to your individual interests. This process also helps us track the effectiveness of our marketing efforts. Our online environments are not designed to respond to “do not track” signals from browsers.

Do Not Track/Opt-Out of Targeted Advertising

Our services use several common tracking tools. These may include browser cookies, web beacons, flash cookies, and similar technologies. Service providers also use these tools on Our Services. and elsewhere on our behalf. We also share information about your use of our services with our social media, advertising and analytics partners. If our system detects a Global Privacy Control (GPC) opt-out preference signal, our system will generally recognize and honor it. Because there is no standard process to interpret other opt-out preference signals, our system may not recognize them. You may also disable or block cookies and certain other tracking technologies through certain software and browsers. If you block or reject all cookies through your browser some of the functionality of the services may not work properly.

Sharing Your Personal Information

We may share the categories of personal information we obtain about you (as described above) with the categories of third parties listed in this section: 

Vendors and Suppliers – We have relationships with different vendors and suppliers who help us design and maintain our online environments, systems, and computer security, respond to consumer inquiries, email payment reminders, analyze our data, create special promotions, and engage in other information uses described in this Privacy Policy. We do not authorize these vendors and suppliers to use or disclose the information except as necessary to perform services on our behalf or comply with legal requirements.

Co-Branding and Co-Marketing Partners – We may partner with other companies to offer you products, services, or content on a joint or "co-branded" or “co-marketed” basis. If we offer products, services, or content in this manner, you will see both our logo and the logo of our partner. To access such products, services, or content, you may be redirected to our partner’s website and should then refer to their privacy policy to understand how the partner uses your data. 

Legal Requests and Preventing Harm – We will disclose information as reasonably necessary to comply with a law, regulation, or legal request; in response to requests by government agencies, such as law enforcement authorities; to protect the safety, rights, or property of the public, any person, or Tension; or to detect, prevent, or otherwise address fraud, security, or technical issues.

Change of Ownership or Control – We reserve the right to transfer personal information we have about you in the event we sell or transfer (or contemplate the sale or transfer of) all or a portion of our business or assets (including in the event of a merger, acquisition, joint venture, reorganization, divestiture, dissolution, bankruptcy, liquidation, or similar transaction or proceeding). 

 

OTHER IMPORTANT INFORMATION ABOUT OUR RELATIONSHIP WITH THIRD PARTIES

Links to Other Sites – Our service may contain links to other websites that are not operated by us. If you click on a third-party link, you will be directed to that third party's site. We strongly advise you to review the Privacy Policy of every site you visit.

We have no control over and assume no responsibility for the content, privacy policies or practices of any third-party sites or services.

Social Media Plugins – Our online environments may use social media plugins (for example, the Facebook "Like" button or "Share to X" button) to enable you to easily share information with others. When you visit our online environments, the operator of the social plugin can place a cookie on your device, enabling that operator to recognize individuals who have previously visited our online environments. If you are logged into the social media website (for example, Facebook, X, Google+) while browsing on our online environments, the social plugins allow that social media website to receive information about your visits to our online environments. The social plugins also may allow the social media website to share information about your activities on our online environments with other users of their social media website. For example, Facebook Social Plugins allow Facebook to show your "Likes" and comments on our online environments to your Facebook friends. Facebook Social Plugins also allow you to see your friends' Facebook activity on our online environments. We do not control any of the content from the social media plugins. Your Rights and Choices Regarding your Personal Information
General Privacy Rights

We offer you certain choices in connection with your personal information, which may vary based on the privacy laws in your jurisdiction of residence.  To the extent permitted by applicable law, you may update your preferences, limit the communications you receive from us; submit a request to access and correct the personal information we have on record about you; file a complaint; or withdraw consent where it was provided for the collection, use, or disclosure of your personal information by contacting us using the information in the “Contact Us” section below. You can unsubscribe from our marketing mailing lists by following the “Unsubscribe” link in our emails. You also may update certain of your account details and settings by logging into your account.

Your California Privacy Rights

In addition to the rights set forth above under General Privacy Rights, California residents have certain rights with respect to personal information under certain laws including the providers California Consumer Privacy Act and the California Privacy Rights Act (as each may be amended or modified, from time to time, and including any regulations promulgated thereunder) (collectively referred to as the “CCPA”):

Notice at Collection

At or before the time of collection of your personal information, you have a right to notice of our privacy practices, as provided above in this Policy, including the categories of personal information and sensitive information that We collect, the purposes for which We collect and use that information, how long the information is retained, and whether that information is sold or shared.

Rights to Know, Correct and Delete

You have a right to request that we tell you the personal information we have collected about you, the right to request additional information about how we use, sell and share your personal information, the right to correct inaccurate personal information that we have about you, and the right to request the deletion of your personal information. Note that we have provided much of this information in this Privacy Policy. You also have rights to request that we correct inaccurate personal information and that we delete personal information under certain circumstances, subject to a number of exceptions. Those rights are described above under “General Privacy Rights“, and to exercise those rights, see the “Contact Us” section of this Policy.

Do Not Sell or Share My Personal Information

If you are a California resident, you have a right to opt-out from the “sale” or “sharing” (as those terms are defined under the CCPA) of your personal information with third parties. To exercise this right, you may modify your Cookie Preferences. We do not knowingly “sell” or “share” the personal information of minors under 16 years old.

Retention of your Personal Information

Tension will retain your personal information only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use your personal information to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.

We will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of our service, or we are legally obligated to retain this data for longer time periods.

Security of your Personal Information

The security of your personal data is important to us, but no method of transmission over the Internet, or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security.

Children's Privacy

Our online environments are designed for a general audience and are not directed to children. In connection with the online environments, we do not knowingly solicit or collect personal information from children under the age of 13 without parental consent. If we learn that we have collected personal information from a child under age 13 without parental consent, we will either seek parental consent or promptly delete that information. If you believe that a child under age 13 may have provided us with personal information without parental consent, please contact us as specified in the “Contact Us” section of this Policy.

Changes to this Privacy Policy

We may update our Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page and by changing the “Last Updated” date at the top of this Privacy Policy.

You are advised to review this Privacy Policy periodically for any changes. Changes to this Privacy Policy are effective when they are posted on this page.
